At eSense Health Inc. (“eSense,” “we,” “our,” or “us”), we are committed to protecting your privacy and handling your personal information with care, transparency, and respect. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you access or use our website and our web-based digital therapeutic programs (collectively, the “Products”).

This Privacy Policy should be read together with our Terms of Use and Refund & Cancellation Policy.

1. Scope and Definitions

Personal Information means information about an identifiable individual, including name, email address, contact details, and other information that can reasonably be linked to you.

Response Data means your responses to exercises, reflections, journals, questionnaires, and other in-program prompts, including self-reported information relating to health or well-being.

Activity Data means high-level information about your use of the Products, such as module completion status, progress indicators, session timing, and usage duration.

Transmission Data means technical log data such as IP address, browser type, device information, and timestamps associated with your use of the Products.

Purchase Information means information provided in connection with a transaction, including name, email address, billing details, product or access level purchased, price paid, date of purchase, and referral source.

2. Eligibility

Our Products are intended for individuals 18 years of age or older. We do not knowingly collect personal information from individuals under 18.

3. Information We Collect and How We Use It

a) Account and Access Information

When you create an account, we collect information such as your email address, login credentials, and related account details. This information is used to create and manage your account, provide access to the Products, and communicate with you about your use of the Products.

b) In‑Program Response Data

You may choose to complete exercises, reflections, journals, and other activities within the Products. This Response Data is stored securely and is accessible only to you within your account. You may also choose to download PDF versions of certain exercises and store them locally on your own device instead of saving them within the Products.

c) Activity, Progress, and Analytics Data

We collect Activity Data and Transmission Data to understand how the Products are used, to improve functionality, evaluate program effectiveness, and support quality assurance. eSense personnel may view this data only in de‑identified or aggregated form and cannot link such data to individual users for the purpose of monitoring individual progress.

d) Navigator Support Interactions

If you choose to book a session with an eSense navigator, you will be required to provide a name and email address for scheduling and communication purposes. Navigators may also be assigned an internal identification number associated with your account for documentation.

Navigators do not have access to the information you type into the Products, including your journals, written reflections, tracker scores, or other Response Data. Navigators may view limited, high‑level program progression information (for example, how far you’ve progressed in the program) to prepare for scheduled sessions.

Navigator sessions are not recorded. Any notes created by navigators reference internal identification numbers and non-identifiable information only. Navigators are bound by strict confidentiality obligations, and you control what information you choose to disclose during these sessions.

e) Surveys and Feedback

You may be invited to participate in optional feedback surveys, including surveys administered through third‑party providers such as Qualtrics or Survey Monkey. Participation is voluntary and subject to the third party’s own privacy policy.

f) Purchases and Transactions

We collect Purchase Information to process payments, provide access to purchased Products or add‑ons, administer transactions, and maintain business records. The Products are offered on a one‑time purchase basis, not as subscriptions.

4. Marketing and Communications

We may send you educational, informational, and promotional communications by email relating to the Products, updates, and offerings. You may opt out of marketing emails at any time by using the unsubscribe link included in such messages or by contacting us.

We do not currently send SMS or text messages for marketing purposes. If we introduce SMS communications in the future, we will do so only in compliance with applicable law and with your consent where required.

We will continue to send essential service‑related communications (such as account or transactional messages), even if you opt out of marketing communications.

5. Cookies and Website Analytics

When you visit our website, we use cookies and similar technologies to operate the site, understand usage patterns, and improve performance. These technologies may collect Transmission Data and aggregated analytics information. You can manage cookies through your browser settings; however, disabling cookies may affect certain website features.

We use analytics tools to understand website and Product performance. These tools are used for analytics and measurement purposes, not for sensitive behavioral profiling.

6. How We Share Information

We do not sell personal information. We may share personal information with trusted service providers who assist us in operating the Products (such as hosting, payment processing, analytics, communications, and professional services), subject to confidentiality and security obligations.

We may also disclose personal information where required or permitted by law, including to comply with legal processes, protect rights and safety, or in connection with a business transaction such as a merger or financing.

7. De‑Identified and Aggregated Data

We may de‑identify personal information so that it can no longer reasonably be linked to you. De‑identified and aggregated data may be used for product improvement, evaluation, research, and reporting purposes, and may be shared with partners, researchers, or regulators in that form.

8. Data Retention and Deletion

We retain personal information only as long as necessary for the purposes described in this Privacy Policy and as required by law.

You may delete your in‑program Response Data at any time using the data deletion functionality within the Products. This action permanently removes such data and cannot be reversed, subject to limited technical retention for backup, legal, or compliance purposes.

Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict the processing of your personal information, or to withdraw consent. To exercise these rights, contact us using the information below.

If you are a California resident, you may have additional rights under applicable California privacy laws.

We use physical, administrative, and technical safeguards designed to protect personal information against loss, misuse, and unauthorized access.

11. International Transfers

Your personal information may be processed and stored in Canada, the United States, or other jurisdictions where our service providers operate. We take steps to ensure appropriate safeguards are in place for such transfers.
